Information to read before entering into an insurance contract

The insurance object is property interests that do not contradict the legislation of Ukraine related to compensation by the person whose civil liability is insured for damage caused to the life, health, and property of victims as a result of the operation of a secured vehicle.

Motor third party liability insurance covers a single risk - a road traffic accident. Compensation is paid to the injured party. The culprit of the accident is also protected: the financial burden is lifted from his shoulders.

When concluding the Policy, restrictions may be imposed on:
- vehicle insurance not registered according to the Law of Ukraine "On Road Traffic";
- vehicle insurance used to provide paid passenger or cargo transportation services; minimum and maximum ages of persons who may drive vehicles;
- the maximum mileage of the Vehicle during the Policy period.

The policy provides compensation:
- 250 000 UAH per victim (1.25 million UAH per event) for property damage.
- 500 000 UAH (5 million UAH per event) for damage to health or life.

The insurance payment under the Policy shall be determined by the Insurer independently based on the methodology for calculating the insurance tariff for the relevant insurance product developed and approved by the Insurer by NBU Resolution No. 108 dated 31.05.2022.

The franchise is not applied (UAH 0).

The territory of operation - Ukraine.
Validity period - 1 year, except for cases:
1) vehicles subject to mandatory technical inspection (hereinafter referred to as "MTI") - for a period not exceeding the date of the next MTI;
2) unregistered vehicles - for the period before their registration;
3) temporarily registered vehicles - for the period until their permanent registration;
4) vehicles registered in foreign countries - for their stay in Ukraine.
The minimum validity period in the cases listed above is 15 days. The insurance agreement may specify the duration of the vehicle, which may not be less than six calendar months.

1. The Policyholder who, when concluding the Policy, provided information essential for assessing the insurance risk and/or information about other circumstances taken into account when determining the insurance payment that turned out to be unreliable, which resulted in a reduction of the insurance payment under the Policy, shall be obliged to pay a fine to the Insurer that made the insurance indemnity in the amount of five times the insurance payment, but not more than 50 percent of the insurance indemnity.
2. If the terms and conditions of the Policy provide for restrictions on the conditions of use of the vehicle other than those provided for in Article 13 3 of the Law, the person who caused the accident and used the vehicle in violation of such conditions shall be obliged to pay the Insurer that made the insurance indemnity a fine equal to ten times the insurance payment, but not more than 50 percent of such insurance indemnity.
3. If failure to perform (improper performance) by the relevant person of the obligation provided for in part two of Article 33 of the Law has resulted in a violation of the term of insurance payment, the Insurer that has made the insurance payment shall be entitled to receive from such person.
4. In case of non-payment of the Insurance payment, the Policy shall not come into force.
5. Failure to file a claim for insurance indemnity within one year if the damage was caused to the victim's property and three years if the damage was caused to the victim's health or life from the date of the accident may result in denial of insurance indemnity.

The insurance product is not part of any package/agreement. The insurance product can be purchased separately.

To conclude the Policy, the Insurer shall have the following information:
1) information about the Policyholder:- surname, name, patronymic, date of birth (for individuals) or name (for legal entities);
- RNOKPP (or, if absent, passport series and number (for individuals) or EDRPOU (for legal entities);
- date of birth of the owner/user of the vehicle;
- place of registration/residence (for individuals) or location (for legal entities);
- whether the Insured is a resident of Ukraine;
- telephone number and e-mail address;
2) information about the vehicle: type, make, model, year of manufacture, registration number, VIN (body, chassis, frame number), engine capacity (cm3), engine power (for electric vehicles), gross weight (kg), unladen weight (kg), number of seats, including the driver's seat, country of registration of the vehicle; odometer readings as of the date of concluding the contract (km), estimated maximum mileage of the vehicle during the Policy period;
3) to receive the benefit, whether the Insured or the driver of the Vehicle is a citizen of Ukraine, a combatant, an injured participant of the Revolution of Dignity, a war veteran, a person with disability of group I or II, a person affected by the Chornobyl disaster of category I or II, a retired person;
4) whether the vehicle is used to provide paid passenger and/or cargo transportation services;
5) place of registration (residence) of the owner/user of the vehicle (individual) or location of a legal entity in accordance with the vehicle registration document;
6) age of persons who may drive the vehicle;
7) information on the term of validity of the Policy;
8) other information required by the Insurer and provided for when concluding the Policy.

Before concluding the Insurance Agreement, you should read the information on exclusions from insured events and grounds for refusal to make insurance payments, limits of liability of the Insurer for a particular insured object, insured risk and/or insured event, as well as the procedure for calculating and making insurance payments.
This information is available in the Information to be obtained before entering into the insurance contract.

The Insurance Agreement shall be concluded in the form of an electronic document in compliance with the requirements of the Laws of Ukraine "On Electronic Documents and Electronic Document Management" and "On Electronic Identification and Electronic Trust Services" or by the procedure provided for by the legislation on electronic commerce. The Insurance Agreement shall be concluded by way of adhesion and shall consist of a public part of the Insurance Agreement, which shall be the General Terms and Conditions of the Insurance Product, and an individual part of the Insurance Agreement, which shall be the Policy.
The Insurance payment under the Insurance Agreement shall be paid in full in a single lump sum before or at the time of concluding the Compulsory Third Party Liability Insurance Agreement.

The privileged category includes citizens of Ukraine who are pensioners, Chornobyl victims of category I or II, persons with disabilities of group II, war veterans, combatants and affected participants of the Revolution of Dignity.
This discount can be granted subject to the following conditions: the engine size should not exceed 2500 cm3/electric engine - up to 100 kW, the vehicle belongs to these persons on the right of ownership and is operated by them. The cost of the policy is reduced by 50%.

In case of a change of ownership of the Vehicle as a result of its lawful alienation, the Policy shall remain valid until its expiry, and the rights and obligations of the Policyholder shall be transferred to the new owner of the Vehicle. In case of a change of ownership of the Vehicle, the new owner shall notify the Insurer in writing and provide the Insurer with his/her data within 15 calendar days from the date of acquisition of ownership of the Vehicle.
In case of death of the Insured - an individual, his/her rights and obligations under the Insurance Contract shall be transferred to the person who inherited the vehicle specified in such Insurance Contract and/or who, in the case provided for by the Civil Code of Ukraine, is considered to be the person who has accepted the inheritance. The right to receive a part of the Insurance payment in case of early termination of the Insurance agreement due to the death of the Insured - an individual shall be transferred to the person who inherited the vehicle specified in such Insurance agreement and/or who, in the case provided for by the Civil Code of Ukraine, is considered to be the person who has accepted the inheritance. In case of a change of the owner of the secured vehicle, the new owner shall notify the Insurer in writing and provide the Insurer with his/her data within 15 calendar days from the date of acquisition of ownership of the vehicle.

- The MTSBU, at the expense of the Victims' Protection Fund, makes a routine payment under the terms set out in Law 3720 in the event of damage in Ukraine:
1) by a vehicle for which there was no valid contract of compulsory civil liability insurance as of the date of the road traffic accident, except for damage caused to a vehicle for which there was no valid contract of compulsory civil liability insurance as of the date of the road traffic accident and to property in it;
2) life or health of the injured individual by an unidentified vehicle. Damage caused to the property of the injured individual is compensated if the damage to the health of the injured individual is caused in the form of a permanent loss or reduction of professional or general working capacity or if the death of the injured individual occurs as a result of a road traffic accident. If a road traffic accident is caused by an unidentified vehicle on the territory of Ukraine, for Law 3720, the relevant unidentified vehicle is deemed to be a vehicle registered in Ukraine;
3) a vehicle that has left the owner's possession as a result of unlawful acts committed by another person;
4) a vehicle in respect of which, as of the date of the road traffic accident, an internal insurance contract was concluded with an insurer that, as of the date of submission of the application for a routine payment, was not entitled to carry out compulsory civil liability insurance due to termination of membership in MTSBU, and such insurer (its successor), upon expiration of the period specified by Law 3720 for deciding on insurance payment, did not make a corresponding decision or made a decision on insurance payment, but failed to do so, as well as in the event of bankruptcy proceedings against such insurer or liquidation of such insurer - to fulfill its obligations under internal insurance contracts;
5) a secured vehicle driven by a police officer, military officer, or employee of a healthcare facility to whom the driver has provided such a vehicle by the requirements of the law if the insurer has not made an insurance payment.
Scheduled payments provided for in this part shall be made exclusively directly to the injured person, his/her legal representatives or heirs, the legal successor of the injured legal entity, persons agreed with the injured person who provide services for the repair of the damaged property, persons who provide treatment to the injured individual, or persons who incurred expenses for the treatment of the injured individual. It is allowed to make the routine payment specified in clause 4 of part one of this Article to the insurer of the injured person who made the insurance payment by Article 19 of Law 3720, or to the insurer who made the insurance payment in connection with damage to the vehicle as a result of a road traffic accident under another insurance contract in respect of the respective vehicle and road traffic accident.
Any transactions that provide for the granting (transfer) of the right to receive the statutory payments specified in this part shall be void.

Direct settlement of insurance claims is a system of compensation for losses caused by a road traffic accident under which the victim may receive an insurance payment for damage to the vehicle from his or her insurer (which he or she has chosen and insured his or her civil liability), rather than from the insurance company of the culprit, as is the case under the usual settlement procedure. In the event of an accident involving only two insured vehicles (from 2025, involving only two vehicles, of which the vehicle of the injured person is covered by a policy concluded after 01 January 2025), and in which the injured person suffered damage exclusively in the form of damage or physical destruction of such vehicle, the injured person is entitled to a direct settlement of the insured event.
"Direct settlement of an insured event involves the exercise by the insurer of the injured person of the rights and obligations of the insurer of the responsible person as defined by the Law to consider the claim for insurance payment, make a decision based on the results of its consideration and make an insurance payment if the relevant decision is made" (provision of the Law).
In practice, this means that your insurance company will settle the insured event and you will not have to contact the insurance company of the person at fault.
The procedure for registering an accident under the direct settlement system is standard: The accident can be recorded by the National Police or by the parties to the accident themselves, using the Europrotocol (taking into account the specifics of its application).
Next, drivers notify their insurance companies of the occurrence of an insured event by the requirements of the Law of Ukraine on MTPL (Motor Third Party Liability Insurance). After that, the victim applies to his or her insurance company with which the contract was concluded with a claim for insurance compensation and awaits payment.
It is also important to note that the victim can only use one method of settlement: either through a direct settlement or the classic route. It is not possible to file a compensation claim simultaneously with the insurance company of the at-fault party and with your own insurance company under a direct settlement.
